These Terms of Service ("Terms") govern your use of the Occupancy Guard mobile application and related services (the "Service"), operated by Erbacci LTD ("we", "us"). By using the Service you accept these Terms.
You must be at least 18 years old, the owner of (or authorised to install software for) the Ring video doorbell/camera you connect to Occupancy Guard, and authorised to monitor arrivals at the entrance of the property you manage. The Service is currently offered only in the United States.
Occupancy Guard is a tool for short-term-rental hosts. It watches a Ring camera or video doorbell at the entrance of a property you manage, counts how many guests arrive during a booking window you define, and produces occupancy notifications and timestamped arrival snapshots for use as evidence in a booking or chargeback dispute. Occupancy Guard is an occupancy-awareness tool — not a security system, alarm, or eviction tool. It counts people; it does not identify them, and it does not perform facial recognition.
Occupancy Guard is intended solely for monitoring the entrance or approach to your property. You may connect any Ring camera or video doorbell model, including a device sold as an indoor camera, provided it is positioned so that it views the entrance. You agree not to use Occupancy Guard to monitor the interior living space of a guest's accommodation — many booking platforms prohibit interior cameras outright, and doing so may breach your platform's rules as well as these Terms. You are solely responsible for operating your Ring device lawfully and for giving your guests any notice or obtaining any consent that applicable law or your booking platform requires for exterior recording — for example, disclosing the presence and location of the doorbell in your listing and at the property. Occupancy Guard does not decide who may enter a property and takes no action against any guest; any decision you make based on its notifications is yours alone.
Occupancy Guard is a subscription service. New hosts get a time-limited free trial when they connect the app. The trial is provided and administered through the Ring Appstore and the Ring Billing System: its length, the price that applies after it, and what happens when it ends are shown on the Occupancy Guard Ring Appstore listing before you start it, and you can review or cancel it at any time in Ring My Apps. To keep premium features after the trial, a monthly subscription is purchased through the Ring Appstore. Paid subscriptions auto-renew monthly unless cancelled; you can manage or cancel at any time through Ring My Apps, and paid access continues through the end of the current billing period. Refunds, if any, are subject to the Ring Billing System's policies. The evidence-packet export is included in the subscription and is not billed per use.
When a trial or subscription ends, we stop analysing new arrivals — no further notifications or evidence are produced. You keep read-only access to the evidence already captured for as long as it remains within its retention window, and analysis resumes if you subscribe again.
You agree not to: monitor people without any legally required notice or consent; use the Service for indoor surveillance or for any unlawful purpose; use it as a security, alarm, or eviction system; reverse engineer, decompile, or attempt to extract source code; interfere with the Service's operation; or use automated means to access the Service except through documented APIs.
Occupancy Guard is provided "as is" as an occupancy-awareness convenience layer on top of an existing Ring doorbell. We make no warranty that notifications or counts will be delivered timely, accurately, or at all, and headcounts are estimates that may be wrong. We disclaim any responsibility for decisions made, or harm caused, by reliance on Occupancy Guard notifications or evidence. See the Disclaimer.
To the maximum extent permitted by law, in no event shall Erbacci LTD be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use, arising out of or in connection with your use of the Service.
You may delete your account at any time from inside the app (Settings → Delete account); doing so removes your data per our Privacy Policy. We may suspend or terminate accounts that violate these Terms.
We may update these Terms; material changes will be communicated in-app before they take effect.
These Terms are governed by the laws of the State of Wyoming, United States, excluding its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in the State of Wyoming, unless local consumer protection law in your jurisdiction grants you a non-waivable right to a different forum.
